2. If you are seeking unpaid wages as well as reporting a labor law violation, you should also file a wage claim.

In California, all workers are protected by labor laws. The Labor Commissioner's Office prioritizes and investigates wage theft and other labor law violations. If selected for investigation, your report will be kept confidential to the maximum extent possible under the law.

In order for the N.C. Department of Labor’s Wage and Hour Bureau to assist an employee with a wage dispute, a complaint must be filed with this office. To file a wage complaint, you must contact our Call‐Center at 1‐800‐625‐2267 (1‐800‐NC‐LABOR). An Information Specialist will take the complaint information over the telephone and enter it into our computer data intake system. To better serve you, we ask that you have the following information available when you call:

•    Your name
•    Your address, phone number (if cell phone we need your cell phone carrier)
•    Your email address
•    Your date of birth
•    Your Job description or Title
•    Name of the Employer/Company where you work(ed)
•    Employer’s Physical address (i.e. business location) (cannot accept P.O. Boxes)
•    Employer’s contact information such as:  phone number, email, or fax
•    First and last name of the contact person we need to speak with in regards to your wages (i.e. owner, manager or supervisor)
•    Business Nature (i.e. law office, home health care, restaurant, etc.)
•    Rate of Pay (i.e. $7.25 per hour, 25% commission)
•    Total amount you claim is owed to you by your employer
•    Pay periods you worked but didn't receive payment
•    Date(s) you should have been paid
•    Beginning date of employment
•    Ending date of employment

     Due to the high volume of complaints, our office will not accept complaints for wages due more than one year ago.

You must provide us with your name and contact information if you are filing a complaint for wages. We are unable to accept third party complaints for wages (i.e. girlfriend or wife filing for boyfriend or husband). Our Call‐Center is open from 8:00 a.m. to 4:45 p.m., Monday thru Friday.

Anonymous complaints can only be filed in the following circumstances:

  • E‐Verify
  • Youth Employment

An employee may also take legal action on their own, including small claims court if applicable, without first having to file a wage complaint with this office. However, an employee cannot come back to us to file a wage claim if they take their own legal action in court regardless of the outcome. If an employee files a wage complaint with us and we cannot resolve their complaint, they are still free to take their own legal action.

We do not take wage complaints for less than $50.00.

If your wage complaint deals with your last paycheck, you must wait 10 days after the payday in order to file a wage complaint with this office.

Do you believe that an employer doing business with the Federal Government has discriminated against you in hiring or employment? Do you believe that the reason for the discrimination was based on your race, color, religion, sex, sexual orientation, gender identity, national origin, disability, or status as a protected veteran? Did you ask about or discuss your pay or that of a co–worker and you were fired, demoted, or disciplined because of it? If you answered yes to any of these questions, you can file a complaint with the Office of Federal Contract Compliance Programs (OFCCP). An individual, organization, or group can even file a complaint on your behalf, or for anyone who may be the victim of employment discrimination by an employer doing business with the Federal Government.

You must file a complaint alleging discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, or based on compensation inquiries, discussions, or disclosures, within 180 days from the date of the alleged discrimination, unless the time for filing is extended for good cause shown. Some examples of what might be good cause include, the existence of some extraordinary circumstance that prohibited you from filing before the deadline such as a significant health issue, military deployment, incarceration, or possibly being unaware of the discrimination. These are only a few of the possible examples of good cause. If your complaint alleges a violation based on disability or status as a protected veteran, it must be filed within 300 days unless the time for filing is extended for good cause shown. Extensions of the filing time require approval by the Director of OFCCP. You should include a description of the alleged discrimination and any other related information that would help OFCCP investigate your complaint.

File a complaint with department of labor

Step 2:

Complete the "Complaint of Discrimination in Employment Under Federal Government Contracts" form and submit it by:

  • filing the complaint form electronically with the appropriate OFCCP Regional Office; or
  • mailing or faxing the complaint form to the appropriate OFCCP Regional Office; or
  • filing the complaint form in person with any OFCCP District or Area office.

The appropriate OFCCP regional office location is the office that covers the location where the alleged discrimination occurred. Your signature is required on the complaint form, if it is not on the form when you submit it, we will ask you to sign your form later. You may also submit a complaint by letter that includes all the information requested on the complaint form.

We will review your complaint form, or letter of complaint, and contact you if we need more information.

Step 3:

Call or visit any OFCCP District and Area Office if you have questions about the complaint process, want to discuss your complaint, or would like to learn where to file a complaint.
